Misrepresentation and Omission

Before you invest, you have a right to honest, complete information. When a broker or advisor tells you something untrue about an investment — or leaves out something important you needed to know — that is misrepresentation or omission.

You Made a Decision Based on Bad Information

You can only make a sound decision with accurate information. When a professional misstates the facts or hides them, the responsibility for the resulting loss rests with them — not with you for believing what you were told.

What Misrepresentation and Omission Look Like

• Being told an investment was “safe” or “risk-free” when it carried real risk
• Downplaying or hiding the true risks of an investment
• Failing to disclose fees, commissions, or conflicts of interest
• Misstating how an investment works or how your money would be used
• Leaving out facts that would have changed your decision

Signs You May Have Been Misled

• What you were told turned out not to be true
• Risks you were never warned about cost you money
• You learned of fees or conflicts only later
• The investment did not work the way it was described
• Important information was missing when you decided to invest
