ChapmanAlbin is investigating potential claims on behalf of investors who may have suffered losses due to supervisory and compliance failures at Liberty Partners Financial Services, LLC.

According to a recent FINRA enforcement action, Liberty was censured and fined $55,000 for multiple violations, including failing to maintain a reasonable supervisory system related to recommendations of complex financial products, misreporting financial data, and failing to conduct mandatory anti-money laundering (AML) compliance testing.

Between July 2020 and December 2023, Liberty’s supervisory system failed to meet the standards required under Regulation Best Interest (Reg BI), particularly concerning the recommendation of non-traditional exchange-traded products (ETPs). These high-risk investments—designed for short-term trading—were recommended to retail investors without appropriate supervisory oversight, written procedures, or compliance tools. FINRA concluded that Liberty’s failure to enforce proper policies violated Reg BI, as well as FINRA Rules 3110 and 2010.

Additionally, from December 2022 through September 2023, the firm filed ten inaccurate FOCUS reports and maintained an overstated net capital position due to improperly classified assets. At one point, Liberty was operating below the required net capital threshold while continuing to conduct securities business in violation of federal rules.

Liberty also failed to perform annual independent AML testing between 2020 and 2023, as required under FINRA Rule 3310(c), further compounding their compliance failures.
